Even so, this is a rather minor violation overall, and action should only be necessary if they keep doing it. They should get warned first. After that, if they refuse to put on nx or you catch them again, they have no excuse and will be dealt with accordingly.
for future reference, please SS yourself or someone else telling that person to wear nx over their GM equipment and them complying, and if you catch them without nx again, SS that and they're toast.

It is against the rules because if someone new comes to the server , and ur wearing the hat in public , one of the new people might think ur a gm and u might impersinate a gm's job . Which makes a gm useless. (This is my understanding).

khuddin u do know that by saying that u are breaking the rules right? even if it is just to your friends. Anyone can walk in and see u doing that. It would be best if u didn't do that ever.
